TRAFFICKING IN HUMAN BEINGS
The definition of Trafficking in human beings, internationally recognized, which almost entirely includes the definition contained in the
Palermo Protocol of 2000
, is that one indicated by the
EU Directive 2011/36
which includes:
<< recruitment, transportation, transfer, harbouring or receipt of persons, by means of threat or use of force or other forms of coercion, abduction, fraud, deception, abuse of power, position of vulnerability, giving or receiving payments, benefits to achieve the consent of a person having control over another person for the purpose of exploitation>>.
Sexual exploitation
It is the act of those who exercise power on someone corresponding to those of the right of property forcing her/him to prostitute herself/himself, keeping her in a state of subjugation achieved through violence, threat, deception, abuse of authority or taking advantage of a situation of vulnerability, physical or psychic inferiority or a situation of necessity, or by the promise or to profit monetarily or other advantages to those who have the authority over the person.
Labour exploitation
Work is characterized by exploitation, when it is provided through violence, threats, intimidation or taking advantage of the state of need, vulnerability or needs of workers. We can speak of labour exploitation when one or more of the following circumstances occur:
The systematic payment of low salary clearly different from collective agreements or in any case incommensurate to the quantity and quality of the work performed.
The systematic violation of the statement related to the working time, weekly rest, compulsory expectation and holidays.
The existence of violations of the legislation on safety and hygiene in the workplace, such as to expose the worker to danger to health, security or personal safety
The worker subjection to working conditions, surveillance methods or particularly degrading housing situations.
